Privacy Policy Overview

Birdhouse Websites & Designs, LLC ("Birdhouse," "we," "us," or "our") operates birdhousewebsites.com (the "Site"). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit the Site, use its forms or chatbot, communicate with us, or inquire about our services.

This Policy primarily covers Birdhouse's own Site and business interactions. When Birdhouse hosts, maintains, develops, or supports a client's website, Birdhouse may process information on that client's behalf under the applicable client agreement and the client's privacy policy.

Information we collect

Information you provide

We may collect information you provide directly, including:

  • Your first and last name, company name, email address, and telephone number.
  • The services you are interested in, whether you have an existing website, your website URL, estimated project budget, referral source, and project or support details.
  • Messages submitted through the Site's chatbot or sent by email, telephone, or another communication channel.
  • Project materials, files, credentials, content, images, brand assets, website exports, backups, and other information you choose to provide while working with us.
  • Billing and transaction information needed to issue invoices or process payments. Payment details may be collected directly by the applicable payment provider.

Information collected automatically

When you use the Site, we and our service providers may automatically collect information such as your IP address, browser and device type, operating system, pages viewed, links clicked, referring page or campaign, approximate location derived from your IP address, dates and times of access, and cookie, advertising, or device identifiers.

Client website and hosting data

When providing development, hosting, maintenance, security, analytics, SEO, chatbot, or support services, Birdhouse may access or process information contained in client websites and related systems. Depending on the project, this can include website user submissions, administrative account information, logs, backups, analytics, e-commerce data, and other data controlled by the client. In those circumstances, the client generally determines why and how the information is used, and Birdhouse processes it to provide the contracted services.

How we use information

We may use information to:

  • Respond to inquiries, prepare estimates, schedule conversations, and communicate about projects.
  • Design, develop, host, maintain, secure, optimize, market, and support websites and related services.
  • Provide SEO, advertising, branding, content, application-development, and AI or chatbot services.
  • Manage projects, client relationships, accounts, invoices, payments, records, and support requests.
  • Operate, analyze, troubleshoot, secure, and improve the Site and our services.
  • Measure campaign and advertising performance and understand how visitors find and use the Site.
  • Send marketing or informational communications where permitted, subject to applicable opt-out rights.
  • Prevent fraud and abuse, enforce agreements, resolve disputes, and satisfy legal or contractual obligations.

Cookies, analytics, advertising, and spam prevention

The Site uses cookies, tags, pixels, and similar technologies to provide Site functions, remember choices, measure traffic and campaign performance, and protect forms from spam and abuse. Technologies used in connection with the Site may include Google Analytics, Google Tag Manager, Google Search Console, Google Ads, Google reCAPTCHA, Gravity Forms, and CleanTalk. CookieNow is active on the Site to manage cookie preferences, although Birdhouse's use of its available features is currently limited.

You may manage non-essential cookies through the Site's cookie-preferences tool. You may also block or delete cookies through your browser settings, although doing so may affect Site functionality.

Website chatbot

The Site offers a chatbot that allows visitors to ask questions about Birdhouse and its services. We and our technology providers may process chatbot messages, technical identifiers, conversation history, and related metadata to generate responses, operate and improve the tool, prevent misuse, and follow up when requested. Please do not submit passwords, payment information, confidential client data, or other sensitive information through the chatbot.

Email and marketing communications

We may send communications about inquiries, projects, support, services, or other information relevant to our relationship with you. Klaviyo is connected for email communications, but Birdhouse's marketing use of the platform is currently limited. You may unsubscribe from promotional email using the link in the message or by contacting support@birdhousewebsites.com. Opting out of marketing does not prevent project, billing, security, support, or other transactional communications.

How we disclose information

We may disclose information:

  • To hosting, cloud-storage, email, forms, analytics, advertising, spam-prevention, security, chatbot, project-management, billing, payment, and other providers that support our operations.
  • To contractors and professional advisors who need the information to perform services for Birdhouse and are subject to appropriate obligations.
  • At a client's direction or as reasonably necessary to provide contracted services involving that client's website, systems, or vendors.
  • To comply with law, legal process, contractual requirements, or lawful requests, or to protect rights, safety, property, systems, or users.
  • In connection with a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction.

We do not sell personal information for money. Some privacy laws define certain advertising-related disclosures more broadly as a "sale," "sharing," or targeted advertising. Where required, we will provide the applicable notice and opt-out method.

Third-party services

Providers used in connection with the Site or Birdhouse's operations may include Google services, Gravity Forms, CleanTalk, CookieNow, Klaviyo, Google Drive or other cloud-storage services, hosting and security providers, project-management tools, and Wave, which Birdhouse uses for billing and invoicing. These providers may process information under their own privacy notices and our agreements with them.

Data retention

We generally retain personal information for up to 12 months. We may retain particular records longer when reasonably necessary to provide or support ongoing services, preserve project history or backups, maintain billing, tax, accounting, or contractual records, prevent fraud, resolve disputes, enforce agreements, or satisfy legal obligations. Information may remain in backups for a limited period after deletion.

Data security

We use reasonable administrative, technical, and physical safeguards designed to protect information. However, no transmission, storage, or security system can be guaranteed to be completely secure. Please use approved secure methods when sharing credentials, exports, customer information, or other sensitive project materials.

Your privacy rights and choices

Depending on where you live and subject to applicable exceptions, you may have rights to request access to, correction of, deletion of, or a portable copy of certain personal information. You may also have rights to opt out of certain targeted advertising, sales, sharing, or profiling and to appeal a decision regarding a request.

To submit a request, email support@birdhousewebsites.com with the subject line "Privacy Request." Describe your request and the email address or other information associated with your interaction with us. We may take reasonable steps to verify your identity and authority. We will not unlawfully discriminate against you for exercising an applicable privacy right.

Some browsers transmit Do Not Track or universal opt-out signals. Because Do Not Track is not standardized, the Site may not respond to it. Where applicable law requires recognition of a qualifying universal opt-out mechanism, we will process that signal as required.

Children's privacy

The Site is intended for a general business audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Site. If you believe a child has provided information to us, contact us so we can review and take appropriate action.

Changes to this Privacy Policy

We may update this Privacy Policy periodically. We will post the revised version on this page and update the effective date above. If changes are material, we may provide additional notice as required by law.
